Implementing Basis 1. The Food Safety Law of the People's Republic of China (February 28, 2009 The Seventh Meeting of the Standing Committee of the 11th National People's Congress passed the twelfth session of the Standing Committee of the Twelfth National People's Congress on April 24, 2015 Fourteenth amendments) Article 35: the state enforce the licensingsystem on food production and operation. Engaged in food production, food sales, catering services, should legally obtain permission. However, the sale of edible agricultural products, do not need to obtain permission.
The department of food and drug supervision and administration of the local people's governments at or above the county level shall, in accordance with the provisions of the Administrative Licensing Law of the People's Republic of China, examine the applicant Information submitted according to the requirements of Article 33, paragraph 1, subparagraphs 1 to 4 of this Law submitted, if necessary, inspect and verify the applicant's production and operation sites; andgrant the permission if the application meet the requirements; deny the permission with a written explanation if the application do not meet the requirements.
2. “Measures for the Administration of Food Production Licensing” (Decree No. 16 of the State Administration of Food and Drug on August 31, 2015) Article 2: In the territory of the People's Republic of China, food production activities shall be made in accordance with the law, shall acquire food production permit. The application, acceptance, examination, decision and supervision and inspection of the food production license shall be governed by these Measures.
Article 6: The State Food and Drug Administration shall be responsible for supervising and guiding the management of the national food production license.
The local food and drug supervision and administration departments at or above the county level shall be responsible for the management of food production licenses within their respective administrative areas.
Article 7: The food and drug supervision and administration departments of the provinces, autonomous regions and municipalities directly under the Central Government may, according to the food category and the food safety risk situation, determine the food production license management rights of the municipal and county food and drug supervision and administration departments.
Health food, special medical use formula food, infant formula food production license shall be managed by the provinces, autonomous regions and municipalities food and drug supervision and management departments.
Application Condition
Application Materials 1. Food production license issued
(1) "Food Production Permit Application" (in the food and drug administrative examination and approval and electronic monitoring platform http://as.hda.gov.cn/ register, fill and report);
(2) a copy of the business license (verify original, retain copies);
(3) the legal representative or person in charge of the identity certificate (non-legal representative or person in charge applying for food production license, the agent should submit the power of attorney and the identity documentsof the manager);
(4) the layout of the food production and processing sites and their surroundings, the layout of the functional area layout, process equipment layout and food production process flow chart;
(5) Daily supervisor confirmation form;
(6) List of major equipment and facilities for food production;
(7) Rules and regulations for ensuring food safety, such as inspection records, production process control, factory inspection records, food safety self-examination, health management of employees, unsafe food recall, food safety accident handling,
(8) involving the national industrial policy requirements, shall acquire national industrial policy documents in accordance with the relevant provisions of the industrial policy departments.
2. Change of food production license
(1) "Application for Change of Food Production Permit" (fill and report in the Food and Drug Administration Approval and Electronic Monitoring Platform http://as.hda.gov.cn/);
(2) the original food production license, and its official copy (verify original, retain copies);
(3) other materials relating to the alteration of food production licensing matters.
