Implementing Basis 1."People's Republic of China Fire Law" (announced on October 28, 2008, the People's Republic of China Chairman's Order No. 6) Article XI: To large-scale personnel-intensive places and other special construction projects, construction units, according to Public Security Department of the State Council, Fire protection design documents should be submitted to the fire department of the public security organs. The fire agencies of the Public Security Organs fire shall be responsible for the results of the audit.
Article 13, The first paragraph of item 1: While the construction project, designed in accordance with the national project construction fire technical standards, is completed , it shall be recorded for the completion acceptance, in accordance with the following provisions of the fire inspection: (a) for the construction project regulated by the Article 11, the construction unit shall apply to the fire control agency of the public security organ for fire acceptance.
"Henan Province Fire Regulations" (amended and announced on April 15, 2014, Henan Provincial People's Congress Standing Committee Announcement Twelfth,No.18) Article 23: large personnel-intensive places and other Special construction projects regulated by the Public Security Department of the State Council, construction units or individuals should, in accordance with the relevant provisions of the state and the province, report the fire design documents to the public security organs for audit. The fire control agency of the public security organ shall, within 20 working days from the date of acceptance, make a decision of agreement or disagreement, and the reasons for the disagreement shall be stated. The fire agencies of the Public Security Organs shall be responsible for the results of the audit. The construction project having been approved for fire protection design, if the fire design is changed, should report to the public security organs to re-examine.
Article 25 The first paragraph of item 1: The completion of the construction project, designed according to the fire technical standards of national construction, shall, in accordance with the following provisions of the fire acceptance, check and filing: (a) For large personnel-intensive places and other special construction projects, regulated by the Public Security Department of the State Council, the construction units or individuals should apply to the fire agencies of the public security organs for fire acceptance. Fire acceptance should be completed within 20 working days.
Article 25, item2: The construction project, which has been reported to the fire agency of the public security organs for the record or has been accepted for fire protection, due to alteration, expansion or change the usage, therefore, change the fire design, should be reported to the fire agency of the public security organs to re-record, and re-accepted.
2."Fire Law of the People's Republic of China" (promulgated on october 28, 2008, the President order of the People's Republic of China No. 6) Article XV: public gathering place, before being put into use, or business, construction units or the using units should apply for fire safety inspection to fire department of the public security organs of local people’s government above the county level public security organs fire department to apply for fire safety inspection. The fire service organ shall, within 10 working days from the date of accepting the application, carry out fire safety inspection of the premises in accordance with the fire technical standards and management regulations. To put into use or business is forbidden without fire safety inspection or the inspection does not meet fire safety requirements.
"Henan Province Fire Regulations" (Amended and announced on April 15, 2014, announcement of Henan Provincial People's Congress Standing Committee, the twelfth,No.18) Article 31: the public gathering place, before putting into use or business, construction units or using units should apply for fire safety checks to fire agencies of the local public security organs. The fire service organ of the public security shall, within 10 working days from the date of acceptance of the application, conduct a fire safety inspection to the place. Within three working days from the date of inspection, a decision on whether or not it is qualified should be made, and reasons should be given if unqualified. If the public places, which have been put into use after the fire safety inspection, need expansion or alteration, the construction units or the using units should re-apply for fire safety inspection.
Application Condition 1. construction project fire design audit and construction project fire acceptance
On one of the following situations as new-built, extension, rebuild (include inner & outer decoration, construction heating and transforming usage), the construction unit shall apply to the fire control institution of the public security organ for fire protection design and shall, after the completion of the construction project, issue a fire protection design and shall, in accordance with the following measures, Audit of the public security organs fire agencies to apply for fire acceptance:
(1) Large-scale staff-intensive places
①Sports venues, halls, public exhibition hall, museum exhibition hall with a total construction area of more than 20,000 square meters;
②Civil airport terminal, passenger station waiting room, passenger terminal waiting room with a total construction area of more than 15,000 square meters;
③ Hotels, restaurants, shopping malls, markets with a total area of more than 10,000 square meters;
④ Theaters, public library reading rooms, business indoor fitness, leisure venues, hospital outpatient buildings, university teaching buildings, libraries, canteens, labor-intensive enterprises Processing workshops, temples, churches with a total construction area of more than 2,500 square meters;
⑤Nursery, kindergarten children's room, children's playground and other indoor children's activities, nursing homes, welfare homes, hospitals, nursing homes ward building, primary and secondary school teaching building, Schools, collective dormitories, labor-intensive enterprise employees dormitories with a total construction area of more than 1,000 square meters;
⑥Dance halls, video hall, auditorium, karaoke OK, nightclubs, recreation hall, sauna, Internet cafes, bars, entertainment features restaurants, teahouses, cafes with a total construction area of more than 500 square meters.
(2) Special construction projects
① Large-scale personnel-intensive construction projects being concerned with there above six types;
② State office buildings, power dispatch buildings, telecommunications buildings, postal buildings, disaster prevention command and dispatch buildings, radio and television buildings, archives;
(3) Except for the first two provisions, public buildings with a gross floor area of more than 40,000 square meters or a building height exceeding 50 meters;
④ First class high-rise residential buildings by national standards;
⑤Urban rail transit, tunnel engineering, large-scale power generation, transformation and distribution projects;
According to the Ministry of Public Security Fire Department "on the views of the clear application of fire design audit and fire acceptance of power generation, variable power distribution scale" (Gong Xiao [2013] No. 259), the following power generation, power distribution projects should be included in the fire design audit and fire acceptance:
A. Large thermal power plants with a single capacity of 300MW and above or the total installed capacity of 600MW and above;
B. The hydropower project (including pumped storage power station) with single installed capacity of 300MW and above or the total reservoir capacity of 100 million m^3 and above
C. Hub converting station, areal or regional converting station.
⑥ Factories, warehouses and special stations, terminal on production, storage, loading and unloading flammable and explosive dangerous goods; flammable and explosive gas and liquid filling stations, supply stations, pressure stations.
The above matters do not apply to the construction of residential buildings, villagers self-built residential, disaster relief and other non-staff-intensive construction of temporary buildings.
Application Materials (1) Fire protection design audit declaration form for construction project;
(2)Industrial and commercial business license and other legal identity documents of the construction unit;
(3)Qualification certificate of design unit;
(4)Fire design documents;
(5) Planning permit document of construction project;
(6) Reconstruction project ( including inner and outer decoration, building heating, usage transformation), in addition to providing the above materials, the following materials should be provided at the same time: ① for the reconstruction after September 1, 1998, provide the main building fire license obtained in accordance with the law (including renovation, construction and maintenance) or the legal documents for the filing of the fire; ②The Reconstruction project built before September 1, 1998 should provide where the construction project completion acceptance report and provide the project completion acceptance of legal documents，house property certificate issued by the construction administration department at any can prove that the build time of the file③ leased military or armed police units to carry out the reconstruction of the remaining , provide the military or the Armed Police Force real estate management department approved the consent of the
