Implementing Basis 1. "Food Safety Law" Article 35 of the state of food production and operation of the licensing system. Engaged in food production, food sales, catering services, should legally obtain permission. However, the sale of edible agricultural products, do not need to obtain permission.
2. "Food Business License Management Measures" (State Food and Drug Administration Order No. 17)
Article 2 In the territory of the People 's Republic of China, engaged in food sales and catering services, shall obtain food business license. The application, acceptance, examination, decision and supervision and inspection of the food business license shall be governed by these Measures.
Article 6 The State Food and Drug Administration shall be responsible for supervising and guiding the management of the national food business license. The local food and drug supervision and administration departments at or above the county level shall be responsible for the management of food business licenses within their respective administrative areas.
3. "Henan Province, the implementation of food business license management" (Trial)
Article 3 Units and individuals engaged in food sales and catering services (hereinafter referred to as food operators) may obtain food business activities within the scope of the license and bear the responsibility for food safety in accordance with the law after obtaining the "Food Business License".
Article 7 The Provincial Food and Drug Administration shall be responsible for supervising and guiding the management of food business licenses in the province. The municipal food and drug supervision and administration department shall be responsible for supervising and guiding the management of food business license in the administrative area. The municipal and provincial (city, district) food and drug supervision and administration departments shall, in accordance with the principle of territorial management, be responsible for the acceptance, examination, decision and supervision and inspection of the application for food business license in their respective administrative areas jobs.
Application Condition
Application Materials Applicants need to use the online declaration at http://as.hda.gov.cn (land at Zhengzhou City Food and Drug Administration website, go to Zhengdong Branch website under the service section to see the specific steps to declare online)
(1) Application for Food Business Permit;
(2) a copy of the business license or other subject qualification document;
(3) The main equipment layout, operation flowchart and other documents that are compatible with the food business;
(4) Employee health and training management system, food safety administration system, food safety self-inspection, self-examination and reporting system, food business process and control system, place and facilities Equipment cleaning Disinfection and maintenance system (including air conditioning and ventilation facilities), Purchase inspection and inspection record system, food storage management system, waste disposal system, food safety emergency response program and other systems;
(5) other materials prescribed by the Provincial Food and Drug Administration.
