Article 36: As for a construction project which is subject to the approval or verification of the related department as required by the state provisions, if the right to use state-owned land is appropriated, the construction entity shall, before filing the project with the related department for approval, apply to the competent department of urban and rural planning for issuing a written proposal of location.

Article 37: If the construction project is examined to meet the requirements, the competent department of urban and rural planning shall issue submissions within the statutory time limit. For the construction of not meeting the requirements, it will not issue a notice of location and give a written explanation.
In accordance with the limits for examinity and approving authority of the construction project, site submissions is required to subject itself to different levels of management mechanism. The construction projects approved, verified and put on archive by the relevant departments of the State and the province shall be issued by the competent department of urban and rural planning of the provincial people's government. Those approved, verified and put on archive by the relevant departments of the city and county people's governments shall be issued by the competent department of urban and rural planning at the same level.
Application Condition The construction projects obtaining state-owned land use rights through the allocation in accordance with the provisions of the state.
Application Materials 1. Materials required are as follows (Copies are required to check the original and stamped with the construction unit seal and the signature of the construction unit manager)
2. The identity certificate of the legal representative or entrusted agent; The power of attorney of the entrusted agent;
3. Business License of Enterprise Legal Person or Organization Code Certificate;
4. Related and certified documents of the proposed project;
5. Present topographic map;
6. The opinion on the examination and approval of seismic fortification requirements.
Based on the following articles: From 1-5 see Article 28 of Zhengzhou Urban and Rural Planning Management Regulations; And No.6 see Article 28 of Henan's Regulations on Earthquake Resistance and Disaster Mitigation.
