Article 40：To build any structure, fixture, road, pipeline and other engineering projects within a city or a town planning area, the construction entity or individual shall apply to the competent department of urban and rural planning under the people’s government of the city or county or the town people's government specified by the people's government of the province, autonomous region or municipality directly under the Central Government for a planning permit on construction project.
Article 44: Any temporary construction within a city or town planning area must be subject to the approval of the competent department of urban and rural planning under the people's government of the city or town. If the temporary construction impedes the implementation of the near-term construction planning, the regulatory detailed planning, traffic, townscape or safety, it shall be disapproved.
Application Condition any structure, fixture, road, pipeline and other engineering projects within a city or a town planning area.
Application Materials Materials required are as follows (Copies are required to check the original and stamped with the construction unit seal and the signature of the construction unit manager)：
1. Administrative licensing application;
2. The identity certificate of the legal representative or entrusted agent; The power of attorney of the entrusted agent;
3. Business License of Enterprise Legal Person or Organization Code Certificate;
4. Certificates of ownership related to land use;
5. Documents related to the approval, verification, and putting-on archive of the construction project;
6. Construction project designing schemes;
7. Checking opinions legally issued by the construction, civil air defense, garden, national security, cultural relics, military and other relevant competent departments;
8. If the construction project requires a site detailed planning, such planning shall be submitted. If the construction project has a greater impact on the regional traffic, then it should submit the traffic impact assessment report; If the construction project has a greater impact on the regional municipal pipe network, then it should submit the evaluation report of the municipal pipe network carrying capacity .
